§ 94-68. Cross connections prohibited.

  • (a)

    Purpose. Chapters NR 810/NR 811, [Wis. Adm. Code], and Wisconsin Plumbing Code require protection of the public water system from contaminants due to backflow of contaminants through the water service connection; and the state departments of natural resources and industry labor and human relations require the maintenance of a continuing program of cross connections control, which will systematically and effectively prevent the contamination of all potable water systems. This section is intended to prevent such contamination.

    (b)

    Cross connection defined. A cross connection is any physical connection or arrangement between two otherwise separate systems, one of which contains potable water from the village water system and the other, water from a private source, water of unknown or questionable safety, or steam, gases or chemicals whereby there may be a flow from one system to the other, the direction of flow depending on the pressure differential between the two systems.

    (c)

    Prohibited. No person shall establish, permit to be established, maintain or permit to be maintained any cross connection. No interconnection shall be established whereby potable water from a private, auxiliary or emergency water supply other than the regular public water supply of the village may enter the village system unless such water supply and the method of connection and use of same have been approved by the water utility and the department of natural resources in accordance with NR 811.09(2), Wis. Adm. Code.

    (d)

    Inspections required. The water utility director shall cause inspections to be made of all properties served by the public water system where cross connections with the public water system are possible. The frequency of inspections and reinspections based on potential health hazards involved shall be as established by the utilities and as approved by the department of natural resources.

    (e)

    Enforcement. The water utility may discontinue water service to any property where any connection in violation of this section exists and take such other precautionary measures necessary to eliminate any danger of contamination of the public water system. Water service shall be discontinued only after reasonable notice and opportunity for hearing under section 2-366 et seq., of this Code, except as provided in subsection (f) of this section. Water service to such property shall not be restored until any cross connection has been eliminated.

    (f)

    Emergency discontinuance. If it is determined by the water utility that a cross connection or an emergency endangers public health, safety or welfare and requires immediate action and a written finding to that effect is filed with the village administrator/clerk/treasurer and delivered to the customer's premises, service may be immediately discontinued. The customer shall have an opportunity for hearing under section 2-366 et seq., of this Code within ten days of such discontinuance.

    (g)

    State plumbing code adopted. The state plumbing code, ILHR 82, Wis. Adm. Code, is adopted by reference as a part of this section.

    (h)

    Application of section. This section does not supersede the state plumbing code and the village plumbing code but is supplementary to them.
