§ 70-31. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Occasional sale means and include all general sales open to the public, conducted from or on a residential premises in any residential zone as defined in the village zoning ordinance for the purpose of disposing of personal property, including, but not limited to, all sales entitled "garage," "lawn," "yard," "attic," "porch," "room," "backyard," "patio," "flea market," "rummage" or other similar sales advertised for the public to attend. This definition shall not include a situation where no more than six specific items are held out for sale and all advertisements of such sale specifically names those items to be sold.

    Person means and include individuals, partnerships, corporations, voluntary associations or members of a family residing in a household conducting the sale.

    Personal property means property owned, utilized and maintained by an individual or occupant of his residence. This shall not include farm equipment, motor vehicles, lumber, fruit and vegetables being sold and displayed in commercially zoned areas of the village.
